Five years later, the court again cited the same reasoning and ruled that sentencing a juvenile to life without parole for a non-homicide crime also violated the Eighth Amendment?s ban on cruel and unusual punishment.

Both cases were decided by 5-to-4 votes, and both were written by Justice Kennedy.

Now the justices are being asked to extend that same reasoning yet again, this time to bar the imposition of life-without-parole sentences to convicted murderers who were 14 years old at the time of their crime.

?We are not suggesting that states should not be able to impose very harsh punishments and very severe sentences on even children who commit these kinds of violent crimes,? Bryan Stevenson, a Montgomery, Ala., attorney, told the justices.

?What we are arguing is that they cannot do so [while offering them] no hope of release,? he said.

Stevenson told the court that young offenders are less culpable than adults for the crimes they commit. Studies have shown that biologically and psychologically, teens are more susceptible to peer pressure and more prone to impulsive and reckless behavior. Studies show that their judgment and character are not yet fully formed.

These factors must be considered in meting out appropriate punishment for crimes, Stevenson said. His argument wasn?t simply for leniency. He said life in prison with the possibility of parole could be an appropriate sentence in certain cases.

But he said that sending a 14-year-old to prison with no hope of release is cruel and unusual under the Constitution?s Eighth Amendment.

?It would be cruel to declare these children fit only to die in prison given what we now know about their status, about their development, and about their potential,? he said.

Urging the high court to uphold Alabama?s sentencing scheme, the state?s solicitor general, John Neiman, said it should be up to state lawmakers to decide whether to punish the state?s worst criminals with a mandatory sentence of life without parole ? even when they are as young as 14.

?The government?s primary goal here is expressing the retributive judgment about the wrongfulness of murder,? he said. ?I think governments are quite legitimate and quite reasonable when they also say that they don?t want to roll the dice on convicted murderers.?

Arkansas Assistant Attorney General Kent Holt offered a slightly different argument. ?The punishment for this crime reinforces the sanctity of human life and it expresses the state?s moral outrage,? he told the justices.

Heavy fighting in Syrian capital: residents

AMMAN (Reuters) - Rebels fought security forces in Damascus on Monday, in the most violent gunbattles the Syrian capital has seen since the start of the year-long uprising against President Bashar al-Assad, opposition activists said.

The heavy fighting shattered the night calm in the upscale al-Mezze district and came just two days after a double car bombing had killed at least 27 people in the heart of the city.

"These clashes were the most violent and the closest to the security force headquarters in Damascus since the outbreak of the Syrian revolution," said Rami Abdulrahman, who runs the British-based Syrian Observatory for Human Rights.

He said 18 government troops were wounded in the fighting, which broke out just after midnight in the west of the capital, pitching army defectors against pro-Assad forces.

Witnesses said the sound of heavy machinegun fire and rocket-propelled grenades (RPGs) had echoed through al-Mezze for two or three hours.

"There is fighting near Hamada supermarket and the sound of explosions there and elsewhere in the neighborhood. Security police have blocked several side streets and the street lighting has been cut off," a housewife who lives in the area said.

Assad is fighting for the survival of his family dynasty which has ruled Syria with an iron fist for more than four decades, and has shrugged off calls from much of the West and the Arab world to stand aside.

His troops have launched fierce crackdowns against rebels in a number of towns and cities in recent weeks, winning back much lost ground, but the violence has showed no signs of abating and there is no diplomatic solution in view.

A car bomb hit a residential area of Syria's second city Aleppo on Sunday, killing two people, while the powerful explosions in Damascus on Saturday had targeted the criminal police headquarters and an air security intelligence centre.

The United Nations says more than 8,000 people have been killed and some 230,000 forced to flee their home, including at least 30,000 who have escaped abroad. The government says about 2,000 members of security forces have been killed.

Syria, a country which sits on the fault lines of several regional and ethnic conflicts, denies accusations of brutality and says it is grappling with a foreign-backed insurgency.

Reports from the country cannot be independently verified as authorities have barred outside rights groups and journalists.

HUMANITARIAN MISSION

A joint team of experts from the United Nations and the Organization for Islamic Cooperation, led by the Syrian government, have started a mission to assess humanitarian needs across the country, a source close the mission said on Monday.

The group is due to visit areas hit by the uprising including the city of Homs, scene of a month-long siege and military bombardment in February, and Deraa, where the revolt against Assad erupted a year ago.

The U.N.-Arab League envoy for Syria, Kofi Annan, is expected to send a team of experts to Damascus later on Monday to discuss his proposal to dispatch international monitors to Syria in a bid to stem the violence.

Assad, who has received crucial backing from both Russia and China on the U.N.-Security Council, has questioned the worth of such a mission.

As hundreds gathered on Sunday in Damascus to mourn victims of bombings, activists said security forces beat and arrested people at a march of more than 200 when protesters began shouting "the people want to topple the regime".

Among those arrested and beaten was Mohammed Sayyed Rassas, a leader of the National Coordinating Body for Democratic Change (NCB), an opposition group which had visited China and Russia in attempts to promote dialogue between Assad and the opposition.

Most opposition groups have rejected the NCB over its insistence on non-violence and its stance against foreign intervention.

Security forces also arrested Farzand Omar, a doctor and politician from the party "Building the Syria State," when he arrived at the Damascus airport from his hometown of Aleppo.

In Aleppo, Syria's commercial hub, state news agency SANA said terrorists were behind the car bomb that killed two people and wounded 30 others when it exploded in a central area close to a state security office and a church.

The year-long uprising has largely unraveled an alliance between Sunni tribal chiefs and Syria's ruling Alawite minority forged by Assad's father, the late president Hafez al-Assad, who used a carrot-and-stick approach to secure loyalty.

How DNA Origami Creates Supermaterials

Practitioners of traditional origami can fold tiny, colorful bits of paper and make high art. But the growing group of scientists who practice DNA origami can fold genetic code itself, creating intricate nanoscopic materials with incredible properties.

In a new study out this week, scientists used the technique to create tiny structures that can manipulate light by absorbing it differently depending upon how the materials form?which could someday create lenses of amazing power. Previous research has shown that DNA origami can create nanobots that potentially could target and kill cancer cells one day.

So how are researchers around the world bending the very shape of DNA to their will?

Bio Basics

Let?s go back to biology-class basics. DNA is made up of four bases: adenine, thymine, guanine, and cytosine (A, T, C, and G) that bond in pairs. A connects to T; C connects to G. Scientists can take advantage of those relationships to create self-assembling materials. Shawn Douglas, a biophysicist at Harvard University?s Wyss Institute for Biologically Inspired Engineering, says that because those DNA bases will naturally seek out their counterpart, all a scientist needs to do is write up a blueprint. "Since the shape in encoded in the building material, we don?t have to assemble each one," he says.

With DNA origami, the blueprint involves two main components: one long strand of DNA called a scaffold that contains around 7000 bases, and smaller staple strands that have between 30 and 50 bases. As the bases that make up these staples bond to the bases on the scaffold, they fold the scaffold into the appropriate shape (the folding is why it?s called origami). If necessary, scientists can even design the staples to have chemical attachments where the researchers can add other materials.

A researcher sends the blueprints for the staples and scaffolds to a company that synthesizes DNA. When the scientists get the DNA strands back, they mix them together and the DNA particles assemble themselves into the desired shape. Douglas says that even in a mixture the size of a raindrop, scientists can produce anywhere from 50 billion to 100 billion DNA structures in a matter of moments. Inside the vial, the billions of strands are playing a complex game of musical chairs, with the short staple strands racing to attach to the correct spot on one of the scaffold strands before all the spots are taken.

Superlenses and Nanobots

Paul Rothemund, a research associate at CalTech, invented DNA origami six years ago in 2006, designing two-dimensional shapes like stars and smiley faces to show the range of the method. Since then, the method has become more and more popular in the field of bionanotechnology.

Rothemund says that DNA itself is "mostly good as an information storage medium," as evidenced by the incredible amount of genetic code stored in our bodies. But DNA isn?t good at conducting electricity and it?s not very chemically reactive, so, to use DNA origami to make new materials with useful properties, scientists must add other ingredients during the process of folding DNA.

In the study released in Nature this week, for example, scientists in Munich used DNA origami to create two kinds of cylindrical spirals with small gold pieces arranged along the edges?some that spiraled to the left, and others that spiraled to the right.

Spirals may seem like an arbitrary design choice, but they were designed with a specific function in mind. Tim Leidl, who runs the group at Munich that directed the research says, "In our case, the usefulness is that it can interact with light." In the teams? experiments, they put spirals that were all rotated in the same direction into a solution, and then found that the solutions absorbed light differently depending upon whether they contained left- or right-handed spirals. "The main importance of the work is that it shows that using self-assembly you can create materials with a predesigned function," says Anton Kuzyuk, a postdoctoral student who worked on the study.

The spiral experiment is a neat proof-of-concept for now. But in their study, the researchers speculate that future development of this idea could lead to the development of new materials with wild optical properties, such as a negative refractive index. This feature appears in no known natural materials, but scientists have shown that it?s possible for engineered metamaterials, and hope that such materials could be used to develop a superlens, or a perfect lens, that would allow scientists to see objects as small as viruses. The materials could even have applications in the invisibility cloak science that?s under way.

And DNA origami designs reach beyond the realm of hard physics. Just a few weeks ago, Harvard?s Douglas published a paper in the journal Science that described a DNA nanorobot. The nanorobot was engineered to carry antibody fragments and could identify and destroy cancer cells in a petri dish.

While the research is a long way from being tested in humans, it?s still an intriguing demonstration of what this method is capable of building?scientists are just starting to figure out what can be done with DNA origami. "DNA is a very powerful method for constructing things, as evidenced by the diversity of life," Douglas says.

Douglas is getting the next generation of scientists excited about the possibilities. Last year he started a competition called BioMod that encourages undergraduate students from around the world to spend the summer designing their own bio-nanotech project, either with DNA origami or other methods. That project is then entered into a competition at Harvard in the fall. Some of the projects from last year show paths that the field could take in the future, including DNA robots that can move along a track and respond to light, RNA drug delivery systems that can knock out targeted genes or deliver drugs to specific cells, and a DNA processor that can count.

WASHINGTON (Reuters) - The current account deficit widened much more than expected to $124.1 billion in the fourth quarter of 2011, as imports rose and exports dropped, a government report showed on Wednesday.

The Commerce Department said the current account deficit, which measures the flow of goods, services and investments into and out of the United States, widened to 3.24 percent of gross domestic product. That compared to a revised third-quarter current account deficit of $107.6 billion, or 2.84 percent of GDP.

The current account gap for all of 2011 was 3.1 percent of GDP, down slightly from 3.2 percent in 2010.

Analysts polled by Reuters before the report had expected the current account gap to widen to $114.2 billion.

The trade gap widened to $141.1 billion in the fourth quarter, helping to widen the current account deficit.

In addition, the surplus on income flows declined to $50.3 billion, the department said.

HBO suspends filming with horses on 'Luck' drama

LOS ANGELES (AP) ? A horse was injured and euthanized Tuesday during production of the cable television racetrack drama "Luck," the third death in connection with the series, and HBO agreed to suspend filming with horses while the accident is investigated.

The humane group that oversees Hollywood productions had issued an immediate demand "that all production involving horses shut down."

"We are also insisting that this stoppage remain in full effect pending a complete, thorough, and comprehensive investigation," the American Humane Association said in a statement. It noted that the accident didn't occur during filming or racing.

The animal was being led to a Santa Anita Park racetrack stable by a groom when it reared and fell back Tuesday morning, suffering a head injury, according to HBO. The horse was euthanized at the track in suburban Arcadia, where "Luck" is filming its second season.

In the series, which was created by David Milch ("Deadwood," ''NYPD Blue") and looks at racing's seedier side, Dustin Hoffman plays a crime kingpin who's scheming to gain control of a racetrack and introduce casino gambling.

During season-one filming in 2010 and 2011, two horses were hurt during racing scenes and euthanized. HBO defended its treatment of the animals, saying it's worked with the American Humane Association and racing industry experts to implement safety protocols that exceed film and TV industry standards.

The American Humane Association's film and TV unit, the group sanctioned and supported by the entertainment industry to protect animals used in filming, called for a production halt at the Santa Anita Racetrack after the second horse's death.

Racing resumed after new protocols were put in place and proved effective, Karen Rosa, the AHA unit's senior vice president, said in February.

On Tuesday, Dr. Gary Beck, a California Horse Racing Board veterinarian, said he had just examined the horse as part of routine health and safety procedures before it was to race later in the day. The horse passed the inspection, the AHA said.

"The horse was on her way back to the stall when she reared, flipped over backwards, and struck her head on the ground," Beck said in a statement. An attending veterinarian determined that euthanasia was appropriate, he said.

Dr. Rick Arthur, medical director of the state racing board, said such injuries occur in stable areas every year and are more common than thought. A necropsy will be conducted, he said, which is routine with all fatalities at racing board enclosures.

An American Humane Association safety representative was at the track when the accident occurred and "as always, all safety precautions were in place," HBO said in its statement that said it was "deeply saddened" by the horse's death and was working with the AHA on its inquiry.

The first two horse deaths drew criticism from People for the Ethical Treatment of Animals, which said that safety guidelines used in filming failed to prevent the deaths "so clearly they were inadequate."

Kathy Guillermo, a PETA vice president, said at the time the group didn't consider the matter closed.

"Racing itself is dangerous enough. This is a fictional representation of something and horses are still dying, and that to me is outrageous," she said.

On Tuesday, Guillermo said PETA sent complaints about "Luck" to Arcadia police and an animal humane society in nearby Pasadena.

"Three horses have now died and all the evidence we have gathered points to sloppy oversight, the use of unfit, injured horses, and disregard for the treatment of thoroughbreds," Guillermo said, calling for an immediate halt to filming.

"See I created this sound/ Yes, sir, I shut it down / There's only one #1 / These other n---as are my sons," he sang before the sound dropped out for an emphatic pause.

The Toronto singer wasted no time, responding with a few Twitter lashes in the wee hours on Tuesday morning (March 13): "I was raised old fashioned, you get at me, i get at you... ain't no sideways sh-- about it."

The Weeknd wasn't the only one who came under fire though on a balmy Monday night in NY. Dream opened with the beautifully layered kiss-off " Wake Me When It's Over," widely perceived to be a missive aimed at his ex-wife, singer Christina Milian. "You knew it was over / I knew it was over," he sang before alluding to tabloid pictures that showed the still-married Dream splashing on a beach with a lady friend back in 2010.

When he wasn't airing folks out, The-Dream kept at it, making the case for R&B, a genre pronounced dead more times than we care to count. But government officials are dismissing claims that the company?s operations constitutes casino gambling.

Ma Pau?s busy at the moment putting the finishing touches to its proposed operations at the Krazy Kokonuts, with indications that it will be open for business sooner rather than later.

Prime Minister Roosevelt Skerrit says the Ma Pau operation can?t be considered casino gambling:

?There is no casino gambling in Dominica,? he told Dominica News Online.

?They are slot machines,? PM Skerrit said of the new company?s proposed gambling thrust that he says is allowed under the Lotteries Act.

At least two government ministers have confirmed unofficially that the administration has received several requests from companies wanting to introduce casino gambling in Dominica.

?You would need specific legislation for that, the government has not discussed the matter at all,? Prime Minister Skerrit told DNO.

He has indicated that ?stand alone? casino gambling won?t be entertained in Dominica.

However he?s not ruling out a request being linked to some major hotel or resort project getting due consideration.

?The government may want to put the matter before the Dominican people.?? But as of today the government hasn?t taken any decision on the issue of casino gambling?.

?As it is now it is against the laws of Dominica and it shall remain so until such time that the people of Dominica decide that they may want to revisit those legislation,? PM Skerrit said.

He admitted that the government had received ?a lot of requests from various regional and international companies?.

?But as we indicated we can only engage anybody if they come in with a major project, it can?t be simply let?s put a casino in Portsmouth or Marigot or anywhere ? it has to be a major resort with a minimum number of rooms, and clear conditions and proper legislation to allow it to happen,? the prime minister said.

Galaxy cluster hidden in plain view

A team of astronomers has discovered the most distant cluster of red galaxies ever observed using FourStar, a new and powerful near-infrared camera on the 6.5m Magellan Baade Telescope. The galaxy cluster is located 10.5 billion light years away in the direction of the constellation Leo.

It is made up of 30 galaxies packed closely together, forming the earliest known "galaxy city" in the universe. The findings will be published in the Astrophysical Journal Letters.

Remarkably, the cluster was completely missed by previous surveys, which searched this region of the sky for thousands of hours and were conducted by all the major ground- and space-based observing facilities, including the Hubble Space Telescope. Despite these intense observations, accurate distances for such faint and distant galaxies were missing until the advent of FourStar.

Eric Persson of the Carnegie Observatories led the development of the new camera that enabled these observations. Persson and his team--which includes Carnegie's David Murphy, Andy Monson, Dan Kelson, Pat McCarthy, and Ryan Quadri--equipped FourStar with five special filters to collect images that are sensitive to narrow slices of the near-infrared spectrum.

This powerful approach allows them to measure accurate distances between Earth and thousands of distant galaxies at one time, providing a 3-D map of the early universe.

The 3-D map revealed the conspicuous concentration of galaxies that existed when the universe was only three billion years old.

"This means the galaxy cluster is still young and should continue to grow into an extremely dense structure possibly containing thousands of galaxies," explained lead author Lee Spitler of Australia's Swinburne University of Technology.

Studying this system will help astronomers understand how galaxies are influenced by their environment, evolve, and assemble into larger structures.

The finding is part of a larger survey, the FourStar Galaxy Evolution Survey ("Z-FOURGE"), led by Dr. Ivo Labbe, a former Carnegie postdoctoral fellow, now at Leiden Observatory in the Netherlands. The focus of the survey is to address a classical problem in observational astronomy: determining distances. Only then do you know if a point of light is a star in our Milky Way, a small nearby galaxy, or a large one very far away.

The Z-FOURGE observations are being conducted using the Magellan 6.5- meter telescope at Carnegie's Las Campanas Observatory in Chile. From the first six months of the survey, the team obtained accurate distances for faint galaxies over a region roughly one-fifth the apparent size of the Moon.

Though the area is relatively small, they found about a thousand galaxies at even greater distances than the new cluster.

"The excellent image quality and sensitivity of Magellan and FourStar really make the difference,"Labbe said. "We look forward to many more exciting and unexpected discoveries!"
